According to the VA, the average time it takes for the VA to issue a decision on VA benefits is currently 139 -156 days. However, I have seen it take between 8 months to over a year, depending on the number and complexity of the claims involved. Once a decision is made it will be mailed to you and your representative at this office.

Higher-Level Review Claim:

The VA's goal for completing Higher-Level Reviews is an average of 125 days (4 to 5 months). However, I have seen it take between 6 months and 1 year, depending on the number and complexity of the claims involved. Board Claim:

The Notice of Disagreement was filed to the Board in the Direct Lane on {DATE}

By law, the Board must generally decide appeals in the order they are docketed (initially filed) with the Board, except for those cases advanced on the docket for extenuating circumstances or cases returned to the Board for expedited processing after remand.

The VA has set a 365-day goal for issuing decisions at the Board; however, it could take 5 to 7 years to receive a decision. The target distribution date will take into account both the date by which the case must be decided in order to meet the timeliness goal and the average amount of time it takes to issue a decision from the date the case is assigned to a Veterans Law Judge. The volume of cases at the Board will also impact the distribution date because a high number of cases without enough Veterans Law Judges to review them could create a backlog.
