Generally, we DO NOT waive entitlement to a potential future award of attorney fees when we withdraw from representation. HOWEVER, if the client asks us to waive future entitlement to fees, ask the following questions:

  1. Is there anything else pending?
  2. Are we withdrawing for failure to contact?
  3. Are we withdrawing because we have exhausted all appeal options and determined there is no merit to warrant pursuing the remaining claims?

*This is a case by case determination depending on the amount of work we’ve put into the case, the claims pending at the time of withdrawal, and our ability to contact the client throughout the process.

Whether we are willing to waive any and all entitlement to a potential future award of attorney fees must be approved by Kailey or Amie before sending the release to the VA and the client. If a fee waiver is approved, generate Fee Release to VA and upload to VA portal and email to copy to client and note that we waived entitlement to future awards of attorney fees in the Synopsis in the Case Tab.
