How to Withdraw from Representation
When to Withdraw
Withdrawal is the right call when:
- The veteran has equivalent or better representation elsewhere (active duty in IDES with a PEBLO/MSC, paid attorney already filed, conflicting POA on record) and does not want OSDRI to duplicate
- The veteran explicitly asks to stop
- A conflict of interest is discovered post-engagement
- Per Kailey direction (legal strategy decision)
Always confirm with Kailey before withdrawing on a case where OSDRI is on record at VA as POA.
Pre-Withdrawal Checks
- If you don't have VBMS access, ask someone who does to confirm OSDRI's POA status (VA Form 21-22 on file) before taking action.
- Pull current case state — Class Code, open Tasks, pending submissions, NOI status.
- Confirm no claims are mid-submission that would be orphaned by withdrawal.
Neos Mechanical Steps
- Case Tab → Class Code → flip to WDR
- Case Tab → WDR Date → populate today's date
- Tasks Tab → set ALL open tasks to N/A
- Save the case
